Terms & Conditions of Sale

Terrasport are totally dedicated to customer satisfaction and will make every effort to ensure your online shopping with us is as efficient as possible.

Ordering and Payment

Orders are placed through the shopping basket / checkout system which form an integral part of this site.

You will receive an automated email (if a valid email address has been submitted with your order) when your order is received. Please be aware that your order is only accepted upon receipt of a personal email from a member of the Terrasport team.

All prices listed are inclusive of VAT. All orders to addresses within EU member states will be charged VAT at the current rate, where applicable.

Payments are only taken from credit cards once the goods have been dispatched.

We regret that we cannot offer any credit facilities for internet sales. However, trade customers such as schools, colleges and other authorities will be offered this facility against official orders that are received by post, fax and telephone. Please note that these orders will be despatched as soon as possible on the understanding that payment will be made within 30 days of date of invoice. Continuation of this facility will only be maintained where strict observance of our terms of payment is adhered to.

Dispatch and Delivery

Carriage is charged on all consignments at the current, published rate. Note: Mail orders may require a signature on delivery depending on selected delivery service.

Orders received by 1.30pm for goods that are in stock are dispatched same day, after 1.30pm dispatch is next day and if an item is out of stock (or unavailable for any other reason) you will be notified within a few working hours of placing the order. Terrasport will, by that point, have tried to get an idea of probable delivery date and you will be given the option to cancel your order if that new date is unsatisfactory.

The speed of the actual delivery process will depend on which delivery service is selected.

Please note that any parcel sent by Royal Mail which remains undelivered may not have a claim started on it for 15 working days (i.e. until the parcel is officially deemed to be lost) and the claim process can take up to a further 28 days.

If a parcel is returned to us as undeliverable, we will attempt to re-deliver. Please be aware that this will incur a further postage charge.

The customer is responsible for the disclosure and payment of any import duties or other taxes which apply in the territory to which goods are being sent.

Notification of damage or shortages must be made to Terrasport as soon as possible and certainly within 7 days of receipt of goods. Notification of non-delivery must be made within 14 days of invoice date.

Descriptions

We are careful to ensure that descriptions and photographs represent correctly the products available. As it is our policy to continually improve products, methods and materials, we reserve the right to change specifications from time to time. We will not make any significant variations without your agreement. Goods sold at discount prices as remnants or as substandard stock will be identified and will be stated to be sold as such.

Right to Cancel

We offer a "no quibble" refund policy for any goods (other than those listed in our Returns Policy) for any goods returned within 14 days of receipt so long as they are in "Perfect Condition" and fit for "Re-Sale" at their full selling price. This will not affect your statutory rights.

How to Return

Please contact us to discuss and gain authorisation for the return.

  • Choose a suitable method of postage, i.e. Recorded or Registered (you are advised to take out suitable insurance for the goods you are returning).
  • Retain your Proof of Postage in case the parcel is lost in transit.
  • Note: unless you are returning faulty goods we are unable to reimburse any postage incurred.

Returns Policy

We want you to feel confident about shopping with Terrasport.

You can return any unwanted items within 14 days for a refund or replacement, as long as they are in an unused, saleable condition and in their original, undamaged packaging.

If a consumer forfeits their right to return goods by virtue of the Distance Selling Regulations i.e. by damaging or using the product we may still accept the goods back and offer a partial refund.

We reserve the right to withhold a percentage of the refund value of the goods if the product or packaging is in such a condition that the product needs to be reduced in price for resale!

Please note that with the exception of faulty merchandise, we cannot exchange or accept the return of certain products:

  • Under garments including, baselayers, sports bras, jock straps and athletic supports;
  • Garments with any form of embellishment (e.g. printing or embroidery);
  • Goods made to your specification;

This does not affect your statutory rights.

Any Manufacturer's Warranty offered is in addition to the legal rights a consumer already has under the Sale of Goods Act 1979.

Your Right To Cancel

At Terrasport we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items.

Further, under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any of these items within a period of 7 working days, beginning with the day after the day on which the item is delivered.

Please note that with the exception of faulty merchandise, we cannot exchange or accept the return of certain products:

  • Under garments including, baselayers, sports bras, jock straps and athletic supports;
  • Garments with any form of embellishment (e.g. printing or embroidery);
  • Goods made to your specification;

This does not affect your statutory rights.

Once you have cancelled your contract, please pack the relevant item securely and send the item(s) back to us as soon as possible. For your protection, we recommend that you use a recorded delivery service. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty. If we do not receive the item back from you with the Returns Form, we may arrange for collection of the item from your residence at your cost.

As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that order as soon as possible, and in any case within 30 days after we receive your notification.

SUMMARY OF RIGHTS AND REMEDIES ACCORDING TO THE SALE OF GOODS ACT 1979

Buyers are entitled to goods of satisfactory quality, taking account of any description, the price and other relevant circumstances. If an item has a fault that is present at the time of sale (sometimes referred to as an "inherent" fault), the consumer can complain once it is discovered.

But buyers cannot expect a legal remedy in respect of:

Fair wear and tear:

In the case of Field Hockey sticks, this would include:

  • The head wearing down due to use on synthetic pitches such as sand and water based artificial turf;
  • Pitting on and/or around the head;
  • Damage to decals through normal play;

In the case of Cricket bats, this would include:

  • Flaking/facial cracks to the blade;
  • Loss of power/sweet spot;
  • Handle breakage;

Misuse or accidental damage

In the case of Field Hockey sticks, this would include:

  • Any damage caused as a direct result of a stick collision;
  • Any damage caused by striking the ball with any area other than the front, flat part of the head. i.e. blading or performing the "Argentinean backhand" shot;
  • Lack of maintenance including the application of resins such as stick magic and the regular application of stick tape;

In the case of Cricket bats, this would include:

  • Any damage due to lack of preparation including; sufficient knocking-in and the application of linseed oil, prior to use;
  • Any damage caused as the direct result of a badly mis-timed shot such as playing a Yorker or a thick edge;
  • Lack of maintenance including regular inspections of the toe, edges and blade for signs of cracking or weather damage, the application of fibreglass tape to areas that are flaking or showing signs of facial cracks;
  • If they decide they no longer want the item;

Similarly, buyers cannot expect a legal remedy where goods have faults that they knew about before the sale or that should have been evident on reasonable inspection.

Remedies

If a product that was faulty at the time of sale is returned to the retailer, the buyer is legally entitled to a full refund, if this is within a reasonable time of the sale ("reasonable time" is not defined in law but as a reasonable guide is considered to be within 4 weeks of receipt of goods) or a reasonable amount of compensation.

Additional rights for consumers

A partial or full refund, depending on what is reasonable in the circumstances.

It may be the case that a full refund is not the reasonable option because the consumer will have enjoyed some benefit from the goods before the problem appeared. This needs to be taken into account before a reasonable partial refund can be assessed. In the case of hockey sticks where their expected life is one season (9 months), any refund offered would take into account the age of the stick based on their expected life. In the case of cricket bats where their expected life is two seasons (18 months), any refund offered would take into account the age of the bat based on their expected life.
